Legal analyses, which were prepared by the Ministry of Tourism and Sports (MCRŠ), give the state a good chance to succeed in the remaining three disputes related to the construction of the National Football Stadium (NFŠ). This was stated by the head of the department before Wednesday’s government meeting Rudolf Huliak (independent).
He emphasized that the disputes are dealt with by lawyers engaged by the MCSR. “Our lawyers are already working on it, and we have a great chance to succeed in the remaining three disputes, we have also done a legal analysis,” stated. He also confirmed that in the case of the still invalid judgment, regarding the state subsidy for the construction of the stadium, the state, represented by the MCRŠ, will appeal.
The Municipal Court Bratislava III, in a dispute concerning the provision of over 27 million in subsidies for the construction of the NFŠ, rejected the lawsuit of the MCRŠ, which demanded the return of over 27 million in state subsidies for the construction of the stadium. The department argued unjust enrichment due to the invalidity of the contract concluded in 2013. The court did not accept the plaintiff’s arguments.
The opposing party perceives the court’s decision as confirmation that the contract was valid. In the case surrounding the construction of the NFŠ, four separate proceedings are being conducted, in addition to the payment of the subsidy, they are also dealing with the determination of the purchase price, compensation for damages for the NFŠ company and, finally, a contractual fine for the NFŠ.
NFŠ started building on the site of the original stadium in Bratislava’s Tehelno Pol in 2016. The project was implemented by the NFŠ company, with which the state, on behalf of the Ministry of Education, signed a memorandum defining the construction conditions in 2013 without a competitive process. The state is committed to buying the non-commercial part of the stadium, as well as providing a subsidy of over 27 million euros. In the summer of 2020, the government announced that, based on legal analyses, it would not buy the stadium and demanded the return of the subsidy.
