The publication of complete excerpts from the closed meeting between ministers of the Federal Supreme Court (STF) by the digital newspaper Poder360 caused discontent among the court’s judges. The conversation defined the departure of Minister Dias Toffoli from reporting on the process involving Banco Master.j
The information was initially released by journalist Mônica Bêrgamo, from Folha de S.Paulo and confirmed by Young Pan. The report found that ministers believe that only excerpts favorable to Toffoli were published and suspect that the content was “leaked” on purpose to strengthen the minister’s narrative. Toffoli denies having recorded or disclosed what he talked to with Supreme colleagues.
The Court’s ministers met after this Thursday’s session (12) and spoke behind closed doors. The meeting ended around 8:30 pm and the announcement followed. The assessment of the members of the Court is that the judge’s actions in the Banco Master process have caused unnecessary strain on the Supreme Court.
The report released by Poder360 says that 7 ministers were in favor of keeping Toffoli at the head of Caso Master, against only two (Cármen Lúcia and Edson Fachin). According to the digital newspaper, Minister Flávio Dino was the one who convinced Toffoli to stay away from the case.
In a note signed by the 10 ministers of the STF, they declared that the accusations were “not a suitable case for the allegation of suspicion” and recognized the validity of the acts carried out by Toffoli in the report (read the full text below). However, at the end of the note, they inform that, with the magistrate’s decision, the “Presidency will adopt the necessary procedural measures to extinguish the suspicion action and send the case to the new rapporteur”. The redistribution is scheduled to take place this Thursday, through a draw.

He further stated that, regarding the content of the report, “the response will be presented to the president of the Court”.
