Dino prohibits new laws that make salaries higher than the ceiling – 02/19/2026 – Politics

The minister, of the (Supreme Federal Court), prohibited the application or enactment of new laws that allow the payment of salaries or compensation amounts above the constitutional ceiling — the so-called penduricalhos, suspended by him on February 5th.

Dino said he had made a “complementary reflection” on the initial injunction and that it was necessary to “avoid factual or legal innovations”, as this could “embarrass” deliberations that are the exclusive responsibility of the STF.

In the new decision, he also stated that “the recognition of any new installment relating to a supposed past right is prohibited, other than those already paid on the date of publication of the injunction.”

The judge recalled that the 60-day deadline continues for public administration bodies, at all levels of the federation, to publish the remuneration and compensation amounts they spend, with a specific indication of the laws that underlie them.

Dino also mentioned the 2024 constitutional amendment, which provides that only compensation funds provided for in national law are outside the ceiling. According to the minister, more than a year after the amendment was promulgated, the regulation has not yet been made by Congress.

“It will be exclusively up to the STF to examine the establishment of a transitional regime, if it fails to fulfill its duty to legislate and maintains institutional omission. The appeal already made to the legislator is renewed”, he said in this Thursday’s decision (19).

Dino’s injunction is scheduled to be judged in the STF plenary next Wednesday (25), when ministers will decide whether or not to endorse the measure. The tendency is to confirm the decision.

The largest paycheck was paid by the MP-RJ (Rio de Janeiro Public Ministry) to a prosecutor, who received this amount from August 2024 to July 2025.

With high entry salaries, careers in the judiciary and the Public Ministry quickly reach the constitutional ceiling and, therefore, they seek strategies to continue to increase salaries. In the process, they concentrate the highest super salaries, according to Fernanda de Melo, an expert at República.org, a civil society organization focused on managing people in the public service.

Judiciary bodies also use administrative and budgetary autonomy that allows them to create and expand benefits, without any express provision in law.
