Deputies call for Lulinha’s arrest after INSS CPMI approves breach of banking secrecy

More than 40 opposition deputies filed, this Thursday (26), a criminal representation to the Federal Public Ministry (MPF) requesting the preventive arrest of Fábio Luís Lula da Silva, cKnown as Lulinha, son of President Lula (PT). The document was presented shortly after the INSS CPMI

In representation, the 47 parliamentarians claim that there is sufficient evidence of authorship and materiality of the crimes of passive corruption, criminal organization and money laundering. The deputies maintain that the requirements of the Criminal Procedure Code for the enactment of the precautionary measure are met, especially the need to guarantee public order and prevent possible interference in the investigation.

According to the text, the seriousness of the facts, the direct connection of the person being investigated with the President of the Republic and the concrete risk of flight abroad, concealment of evidence and criminal continuity would justify preventive detention. “The law needs to apply to everyone, without political shielding”, declared deputy Rosângela Moro (União Brasil-SP). “There can be no institutional shielding for anyone. When there is relevant evidence of illegal acts and a concrete risk to public order, the law must be applied with the same rigor, regardless of surname”, he added.

The MPF and the Judiciary will now analyze whether the elements presented meet the legal requirements for the eventual enactment of preventive detention.

In a note released on Wednesday (25), the Silva’s defense stated that the client has no connection with the fraud against INSS beneficiaries, having not participated in embezzlement, nor having received any amounts from criminal sources.

“In view of the incessant media campaign reproducing partial and confidential data from an ongoing investigation, I understood it was necessary to request access to the investigation from the STF”, revealed lawyer Guilherme Suguimori Santos.
