Defendant in the STF, Michely Paiva broke her ankle bracelet in SP, fled to the USA and has been detained by ICE for over a year
The United States immigration court decided to deport the last Brazilian fugitive from the coup acts of January 8th who was living illegally in the country. The decision, taken by an administrative judge in El Paso, Texas, was communicated to the Brazilian courts on February 9.
Michely Paiva Alves, a businessman from São Paulo, has been imprisoned for more than a year in an Immigration and Customs Service (ICE) unit. In Brazil, she is a defendant for five crimes linked to the acts of January 8, 2023. Among the charges is financing a bus that took 30 people from Limeira to an Army headquarters in Brasília.
The trader’s defense appealed to the US Court of Immigration Appeals. The new trial is scheduled for March 11. In the United States, there is no legal provision that the appeal presented by the defense will prevent deportation before the trial scheduled for this month.
In Brazil, Michely’s lawyers argued, in the Federal Supreme Court, that the complaint should be rejected due to lack of evidence that she vandalized National Congress buildings or participated in a criminal organization.
Michely was identified as one of the 1,399 people held responsible for participating in the 2023 coup acts. In 2024, she was under house arrest with an electronic ankle bracelet in Limeira while awaiting trial for two crimes.
The accusation, however, was expanded to five counts, including a coup d’état, which led her to break the equipment and flee to the USA.
