The minister of the (Supreme Federal Court) voted this Friday (6) to accept a complaint against and make the pastor a defendant on charges of slander, insult and defamation for having called generals “lax” during a Bolsonarist demonstration in April 2025.

Malafaia’s trial for the attack on the generals takes place in the virtual plenary of the Supreme Court, in which there is no discussion and the ministers just cast their votes. Moraes is the case’s rapporteur and was the only one to vote until the publication of this text.
If he is followed by the other ministers of the First Panel, a criminal action that will analyze whether Malafaia is guilty or not will be opened in court. In addition to Moraes, the board comprises Flávio Dino (president), Cristiano Zanin and Cármen Lúcia.
In the case of conviction for the crime of bodily harm, Moraes also includes the possibility of an increase in the sentence due to the comment being made against a public official, due to his duties, and in the presence of several people and because the speech was published on social media.
Malafaia was denounced by the (Attorney General’s Office) on December 18, 2025. The case originated from a representation presented by , after a speech by the pastor on Avenida Paulista.

“In short, therefore, it is clear from the complaint the precise indications of when the statements considered slanderous and insulting —duly transcribed in the accusatory piece— would have been made by the accused, in front of thousands of people and also shared on his profile on the social network Instagram”, wrote the minister.
The Attorney General of the Republic, , forwarded the case to Moraes on the grounds that there was a “strict connection between the conduct reported” and the investigations.
Malafaia stated that the case should be sent to the first instance. “What does freedom of expression have to do with a demonstration with a fake news inquiry?
