The minister, of the STF (Supreme Federal Court), informed the Second Panel of the court that he should not participate in the trial on the maintenance of the prison of the owner of the, , in a virtual session of the Second Panel, starting this Friday (13).
Toffoli ordered the decision to be forwarded to ministers Gilmar Mendes, president of the collegiate, and André Mendonça, rapporteur of the case. The minister had been telling interlocutors that he would participate in the decision.
“On this date I declared my suspicion for intimate reasons in the files of Writ of Mandamus No. 40,791/DF, distributed to me. Considering that there is a correlation between the matters subject to that case and those in the files of Pet No. 15,556/DF, I declare my suspicion in accordance with article 145, § 1, of the Civil Procedure Code, for intimate reasons, from this investigative phase”, said.
Earlier, the magistrate declared himself a suspect to report the request for Congress to install a (Parliamentary Commission of Inquiry) to investigate suspected financial fraud in the relationship between the bank and the Bank of Brasília.
He was selected this Wednesday (11) to be the case’s rapporteur. In the decision, the magistrate points out “intimate reasons”, an argument that he repeats in the letter about the prison case. Following this, minister Cristiano Zanin was selected as the new rapporteur for the case
“I would like to emphasize, initially, that any hypothesis of suspicion or impediment of my performance in the processes of the so-called ‘Operation Compliance Zero’ were definitively ruled out, by final and unappealable decision. In this sense, I reproduce the official note from the ten ministers of the Federal Supreme Court, published on February 12, 2026”, said the minister.

In a statement on the occasion of the rapporteur’s departure, the magistrates signed a joint note in defense of Toffoli and stated that “there is no reason to raise suspicion”. “They therefore recognize the full validity of the acts carried out by Minister Dias Toffoli in reporting Complaint No. 88,121 and all the processes linked to it due to dependency”.
The decision came after the Federal Police delivered to the president of the STF, Edson Fachin, a report showing an exchange of messages between Vorcaro and his brother-in-law, Fabiano Zettel, in which they both discuss payments to the company Maridt, which has the minister among its partners.
Mendonça was chosen rapporteur by lottery, which left out only Toffoli himself and the president of the court, Edson Fachin.
Since then, the minister’s continued leadership of the case and his participation in subsequent acts in the processing of processes linked to the case have been discussed.
One possibility was for Toffoli to abstain from voting, which lost strength with the minister’s own indication that he intended to register his position.
