An unusual case drew attention after the court ordered the use of an electronic ankle bracelet on a 68-year-old man who was missing both legs. The situation occurred in Blumenau and generated repercussions after the court decision.

The elderly man had been sentenced to five years in prison for manslaughter in traffic, a crime that occurred more than ten years ago. Initially, the sentence would be served in a semi-open regime.

He was arrested on March 9th. However, the defense asked the court for the sentence to be replaced by house arrest due to the health conditions of the convict, who is in a wheelchair.

The court accepted the request, but determined that serving the sentence at home would be accompanied by electronic monitoring using an ankle bracelet.

The problem arose when the prison unit reported that it would not be possible to install the equipment due to the absence of the convict’s two legs.

Given the situation, the case was reevaluated by the Judiciary. After the new analysis, the Court decided to remove the electronic ankle bracelet requirement and authorized the immediate release of the elderly man to serve his sentence at home.
