The unanimous decision of the CNJ (National Council of Justice), this Tuesday (17), to dismiss judge Carlos Henrique Abrão, from , for 180 days, reverses a long process marked by pressure on magistrates and threats to journalists.

The case originated from documented information that the then president of the Private Law Section, judge Dimas Rubens Fonseca, received from judges Régis Rodrigues Bonvicino and Ligia Bisogni.
Bonvicino, who died in July 2025, refused to sign the ruling amended by Abrão. He reported having been the target of pressure from Abrão.
The CNJ reports that Bisogni, then in the same chamber, arrived after work had begun, and there were questions why a case was judged without his participation.
To get around the situation, Abrão changed the judgment strip, making it clear that the case had been removed from the agenda.
Abrão stated that he was the target of “slanderous denunciation” and that it was “mere political persecution to demoralize me and prevent me from running for a management position again”.
In a note, Abrão states that he will appeal the CNJ decision:
“We respect the CNJ’s decision but we disagree with it and will then present an appeal questioning all the nullities of the procedure. I emphasize that we have been in our career for 39 years, producing 80 thousand votes and not taking a vacation for ten years.”
Misconduct
The CNJ annulled the . The TJ-SP had considered the censorship penalty appropriate. When judging disciplinary review, the rapporteur, Daiane Nogueira de Lira, understood that that decision contradicted the evidence in the case file and the seriousness of the facts.
“It is not a bureaucratic error nor mere negligence. In fact, it is misconduct that affects the essence of legal security”, he stated in his vote.
Daiane repeats the conclusion of the then president of the TJ-SP, Geraldo Pinheiro Franco, when he proposed, in 2021, a disciplinary process:
“In principle, there was tampering with the judgment of a public document after the session ended, not due to error or mistake.”
The rapporteur rejected the allegation of defense restriction.
Intimidation attempt
Abrão tried to intimidate journalists. Here are excerpts from messages received by the column:
“Our lawyers, the Federal Police and the STF, in addition to Minister Alexandre [de Moraes]which combats fakes in the media in general, aiming to find out who the sources are that pass on incomplete and lying information”.
“Unfortunately, they highlight what interests them and publish the malicious spirit of damaging the image and denigrating what was built over 35 years of toga. But be careful, you will be taken to court and don’t say you weren’t warned.”
“The murder of reputation and deconstruction has its days numbered, our lawyers will file criminal complaints against you, slander, defamation and insult in order to spend good years in jail.”
In 2021, the Sheet responded to an extrajudicial notification, sent by Abrão, and denied the request for rectification.
Lawyer Taís Borja Gasparian stated that “the journalistic article authored by journalist Frederico Vasconcelos, entitled ”, published on 12/04/2021, does not present any inaccuracy or untruth capable of giving rise to its rectification, in the form requested by Your Excellency.
The article was published in exercise of the constitutionally guaranteed right and duty to inform. All information disclosed was checked with official and reliable sources, as it is public data.
