PGR defends that Bolsonaro serves his sentence under house arrest

Opinion by the Attorney General of the Republic, Paulo Gonet, points out that the former president needs continuous medical care after being diagnosed with bronchopneumonia

The Attorney General of the Republic, Paulo Gonet, spoke out, this Monday (23), in favor of house arrest to former president Jair Bolsonaro. The recommendation comes after Bolsonaro being hospitalized with bronchopneumoniaon the 13th.

“In the opinion of the Attorney General of the Republic, the need for house arrest is confirmed, providing the necessary care for full-time monitoring of the health status of the former president, who is demonstrably subject to sudden and unpredictable harmful changes from one moment to the next”, says the decision.

The former president has been detained in the General Staff Room of the 19th Military Police Battalion of the DF, known as Papudinha, since January 15th. At the beginning of March, the defense had made a request for him to serve his sentence at home, but it was denied. However, the situation took a turn in the early hours of March 13, when Bolsonaro felt unwell and had to be rushed to DF Star Hospital.

At the health unit, doctors confirmed the diagnosis of aspiration bronchopneumonia by performing a chest computed tomography.

In the opinion sent to the Federal Supreme Court (STF), the attorney general used the medical information to inform your decisionstating that “the health status of the house arrest applicant demands the constant and attentive attention that the family environment, but not the current prison system, is capable of providing”.

The document states that the State has the duty to preserve physical integrity ea life of those in your custody. The PGR highlighted the current vulnerability of the former presidentjustifying the urgency of the measure by pointing out that it is demonstrably “subject to sudden and unpredictable harmful changes from one moment to the next”.

Gonet’s recommendation is that house arrest be granted, but with periodic medical reassessments that prove the need for Bolsonaro to remain at home. The final decision on the transfer will be made by the case’s rapporteur at the STF, Minister Alexandre de Moraes.
