Collegiate would close activities on March 28; If the President of the Senate does not read the extension request, extension will be automatic
Minister André Mendonça, of the STF (Supreme Federal Court), gave 48 hours from this Monday (23.mar.2026) for the president of the Senate, (União Brasil-AP), read the request to extend the work of the CPMI (Mixed Parliamentary Commission of Inquiry) of the INSS (National Social Security Institute). The decision responds to a request from deputies (Novo-RS), the rapporteur (União Brasil-AL) and the president of the commission, senator (Podemos-MG). The collegiate would close its activities on March 28.
The minister ordered Alcolumbre to read the application within the deadline and check whether the request meets the requirements for the extension of the CPMI. The support of at least ⅓ of the members is needed to maintain the investigations. If the Board of Directors does not formalize the extension, the reading will be considered “tacit” –and the continuation of work may be authorized, exceptionally, by the chairmanship of the commission.
Alcolumbre can still appeal the decision through the Senate’s lawyers.
Mendonça understood that it would be necessary “assert the will of a parliamentary minority” . “The parliamentary minority has the subjective right to install and extend the operation of a CPI, simply by requesting a tparliamentarians’ building“, he declared.
For the minister, there was an omission by the board of directors of the National Congress in not reading the request to extend the commission’s work. He stated that it is necessary to preserve the rights of the minority, without the management creating obstacles “devoid of constitutional foundation”.
Mendonça considers that the extension of the CPMI is a matter of jurisdiction of the court, since there is a constitutional guarantee for the opposition. “Thus, the deadline for closing the CPMI-INSS cannot, according to the will of the National Congress itself, exceed the period of the legislature in which it was created”, he stated.
