Analysis: INSS CPMI judgment should measure “temperature” in the STF

The physical plenary of the STF (Supreme Federal Court) judge this Thursday (26) whether to endorse the minister’s decision André Mendonça about the extension of the INSS CPMI.

The trial promises to reveal the “temperature” between people regarding an issue that has gained prominence in recent months. This is what the political analyst at CNN Teo Cury.

Mendonça’s decision to extend CPMI’s work was considered a victory by parliamentarians. The minister understood that this is a parliamentary minority, extending the same understanding that is applied to the installation of CPIs also for their extension.

Although there is consolidated jurisprudence in the STF on the obligation to install CPIs when the necessary number of signatures is reached, as this is a guarantee of the parliamentary minority, there is still no consensus or established precedents on whether the same principle applies to the extension of work.

CPMI focus shift

The INSS CPMI was initially created to investigate retirement and pension fraud, as well as misappropriation of resources intended for retirees and pensioners.

However, in recent times, there has been an apparent deviation from the main focus, with the commission starting to concentrate its efforts on investigating Banco Master, justifying the connection through the payroll loans offered by the bank to retirees and pensioners.

The trial in the physical plenary of the STF gains additional importance as it occurs amid pressures related to the Banco Master case. The decision will serve as a thermometer to measure the level of support among the ten Supreme Court ministers.

In the Second Panel of the STF, there was already a majority in favor of extending the CPMI and , with all ministers agreeing, even though Gilmar Mendes had reservations.

However, the scenario may be different in the full plenary, especially with the participation of other ministers such as Alexandre de Moraes and Dias Toffoli, which will make the debate and discussion particularly interesting to follow.
