The minister of the (Supreme Federal Court) stated this Tuesday (24) that the former president (PL) could have advanced his own medical care if he had activated the “panic button” available to him 24 hours a day in Papudinha, where he was imprisoned.
The rapporteur granted humanitarian house arrest to the former president and said that the medical incident would occur regardless of the place of custody, whether in prison or at home, and, according to him, “the care and removal of the person in custody would hardly be faster and more efficient if he were under house arrest”.
According to Moraes, the procedure to guarantee Bolsonaro’s health in prison was “extremely efficient” and allowed the former president’s immediate transfer to , where he is hospitalized with bronchopneumonia.
“The procedure established to guarantee the health and dignity of the custodian Jair Messias Bolsonaro was extremely efficient, starting at 6:45 am on 3/13, allowing his immediate removal to a private hospital, without any need for specific judicial authorization. It should also be noted that the custodian could have anticipated his own care, if he had activated the ‘panic button’ earlier, which was at his disposal 24 (twenty-four) hours a day”, he wrote in his decision.
“There is, therefore, no doubt about the complete conditions of the prison establishment in guaranteeing the safe and adequate treatment of the prisoner Jair Messias Bolsonaro, with absolute respect for his health and dignity, as well highlighted, unanimously, by the First Panel of the Federal Supreme Court, when ruling out the absence of the necessary requirements for the granting of humanitarian house arrest”, he added.
With this, the minister refuted Bolsonaro’s defense, which argued that keeping him at Papudinha would not provide him with continuous monitoring or immediate response from a health team in the event of a sudden illness.
The concern was also raised by the former president’s doctors. In an interview with journalists on the date he was admitted, cardiologist Leandro Echenique said that “if the treatment was not instituted quickly, this infection, given the speed at which it was, in a few hours, he [Bolsonaro] it could progress to actually needing intubation and it could develop into a generalized infection.”
Bolsonaro’s house arrest will initially last for 90 days, counting from his medical discharge, “for the purpose of full recovery from bronchopneumonia.”
“After this period, the presence of the necessary requirements for maintaining humanitarian house arrest will be re-analyzed, including medical expertise if necessary,” stated Moraes.
The former president (Intensive Care Unit) on Monday night (23), but a medical bulletin released this Tuesday states that he.
Jair Bolsonaro will also need to wear an electronic ankle bracelet again and will be required to stay at home, in a gated community in Brasília.
The request for humanitarian house arrest had been made by the defense since before the final sentence was served for an attempted coup d’état, last November. Bolsonaro was sentenced to 27 years and 3 months in prison.
