The , stated this Wednesday (25) that it will officiate to clarify whether the election for the buffer mandate of the state Executive should be direct or indirect.
Couto stated that he saw a material error in the , which, for him, leaves room for doubts about how the election should be carried out. He said he believes that the decision will be through an indirect election, but that the purpose of the letter is to avoid room for doubts and questions.
“The foundation [da decisão] brings us the north of indirect elections. But the reference to the device indicates a direct election. […] Based on what we have in the voting body, I have no doubt that the election will be indirect. But I have, in a device, in a certificate, an indication of something that leads us to a direct election. So, first, let’s clear up these doubts,” he said.
Couto stated that, given this doubt, there is a possibility that the election for the new governor will take place days after the one-month deadline stipulated by law. He said he sent a letter to Alerj with a warning about the doubt. The judge said that it is up to the Assembly to decide whether to wait for the TSE’s response or whether to call an indirect election.
The judge also asked state deputies to be cautious, who have already started efforts to elect a new president of Alerj (Legislative Assembly) after the immediate impeachment of deputy Rodrigo Bacellar (Union).
He asked them to wait for the totalization of votes to be carried out by the TRE (Regional Electoral Court) so that the new deputy to assume the seat in the Assembly could be defined.
“Even though he is just a deputy, this deputy is interested and the population is interested in knowing who this deputy will be. I say this to the extent that this deputy may want to be a candidate, why not, for the presidency of Alerj? As much as it may seem inappropriate, even though you all may interpret that he would not have a vote, but it would be his right to do so”, he said.
