In an interview with Sheetlawyer Leandro Rosa, responsible for Deltan’s defense, said he is betting on analyzing the new candidacy record – “what happened in the last election remains in the last election” – and beforehand tries to gather “the broadest possible demonstration of evidence to reaffirm his eligibility”.

Deltan was the most voted name in the election four years ago among those competing for federal deputy for , but his candidacy registration for Podemos was rejected by the TSE in May 2023, when he .

For Leandro Rosa, that 2023 decision was “circumstantial, specific, possibly due to the political environment at that time, and which will most likely not be repeated now”. Previously, in the TRE (Regional Electoral Court), also unanimously, the candidacy registration had been approved.

Now he states that, if the candidacy record is questioned again, other elements must be presented by the defense, to try to demonstrate that “the transposition into political life was an organized, reflected project, and not a maneuver with some hidden objective, to avoid a functional problem and use the candidacy as another alternative”.

Lawyer Paulo Henrique Golambiuk, president of Iprade (Paraná Institute of Electoral Law), states that Deltan’s candidacy can be considered “high risk”, since, regardless of the controversies in the case, a jurisprudence in the TSE has already been opened in 2023.

He remembers, however, that, in the Electoral Court, no request for candidacy registration can be summarily rejected.

“There will be a new trial. Those arguments invoked in 2022/2023, for either side, whether from the TRE or the TSE, will naturally appear as subsidies by the parties involved, but the judges in 2026 are not linked to that and will even be other people”, says Golambiuk, remembering that the compositions of the plenary sessions change every biennium.

In 2024, when he had already exchanged Podemos for Novo, Deltan moved to City Hall, but the plans did not move forward and he ended up supporting the candidacy of Eduardo Pimentel (PSD), from the Ratinho Junior (PSD) group and winner of that election.
