PSD goes to the STF for direct election for Government of RJ – 03/27/2026 – Politics

This Friday (27), -RJ filed a complaint with the (Federal Supreme Court) asking for direct elections to be held for the buffer mandate for the position of governor of the .

The acronym of the former mayor of Rio de Janeiro (PSD) states that the (Superior Electoral Court) ordered the holding of a popular election in which it made the former governor ineligible ().

According to the party, the understanding was illegally changed after a difference was identified between the determination and the reasons for the decision.

In the document, the PSD-RJ asks for an injunction to suspend the determination to hold indirect elections for the position of governor.

Pre-candidate for the Guanabara Palace in the October elections, Paes will be given the buffer mandate if decided by popular vote.

This will be the PSD’s second action on Castro’s immediate succession. The STF will judge until Monday (30) after the party’s action.

The debate over the direct or indirect election revolves around the , which took place on Monday (23), the day before the trial in which he was convicted of abuse of political power.

With his departure, the double vacancy in the positions of governor and deputy occurred before the trial, which, according to the state Constitution, would lead the state to an indirect election. In this case, state deputies are responsible for choosing the new buffer governor, with a mandate until the end of 2026.

If Castro had been tried while still in office, there was a possibility that the TSE would order new direct elections. The legislation provides that the impeachment determined by the Court for electoral reasons requires the replacement of the position by popular vote, unless the conviction occurs in the last six months of the term.

In the complaint, the PSD-RJ states that the resignation was an “evident and flagrant fraud against the law and a fraud on the authority of the TSE, consisting of an attempt to escape the punishment of loss of mandate”.

The controversy intensified due to two certificates issued by the TSE itself regarding the trial.

In the first, issued shortly after the judgment, the Court expressly determines the holding of new direct elections.

The second was issued after the interim governor, judge, president of the Court of Justice, pointed out a contradiction between the legal provision mentioned in the certificate, which led to the popular election, and the basis of the votes cast in the session on Tuesday (24), after Castro’s resignation.

In the trial, the ministers suggest considering the former governor’s resignation as valid, as they consider the debate on the revocation penalty to have been overcome.

The TSE issued, on Wednesday (25), a new certificate alleging a material error, in accordance with the state Constitution.

“The Judicial Secretariat of the TSE, instead of confirming the terms of the votes given by the Ministers, issued a new and illegal certificate of judgment to indicate that the succession to the position of governor of the State should occur through indirect elections”, he states.

The PSD wants a direct election so that Paes can compete without having as his opponent a governor with the state machine in hand. The former mayor alleges that Castro’s group could commit the same abuses highlighted in the 2022 election, which led to the former governor’s ineligibility.

The PL, in turn, counts on the indirect election to increase the knowledge of deputy Douglas Ruas (PL) among the population already in the position of governor. He is the favorite to run for the position in the Alerj election.
