The Brazilian Judiciary spent R$ 718.6 million in 2025 with health aid for its magistrates, considering active and inactive judges. The money is used to pay for health plans and also for reimbursement in the case of private procedures at hospitals or dentists.
This benefit can be paid from April 2026 without entering the limit for hanging of up to 70% of the constitutional ceiling (which is currently R$46,366.19), defined by .
In most cases, health aid is also not subject to income tax. This means that the money falls freely into the judge’s account, without any discount.
The values shown in the infographic above are underestimated because there are courts that do not detail the funds classified as “compensation”. There are also bodies that did not send information for all months of 2025 to the (National Council of Justice), which .
COURTS THAT SPEND THE MOST
The court that spent the most on health aid in 2025 was São Paulo, which also represents the most populous state in Brazil. The TJ of Minas Gerais was the 2nd that paid the most benefits, followed by Paraná.

STF DECISION
The plenary session approved on Wednesday (25th March) the payment of benefits to judges and members of the Public Ministry in up to 70% beyond the constitutional ceilingwhich today stands at R$46,366.19. With extrateto authorization, the remuneration can reach R$78,822.52. The distribution was this:
- first 35% extra – they can come from penduricalhos, which include various aids;
- another 35% more – are possible from the return of the ATS (Additional Time of Service), known as five-year period, which is an additional installment for time of service, of 5% for every 5 years of work.

The measures are valid from April 2026. The ATS was resurrected after at least 20 years, as it had been extinguished in 2001 for Executive and Legislative employees and in 2005 for the judiciary — the result of strong popular pressure to end this benefit. Here is the signed thesis (PDF – 541 Kb).
Payments made when a judge needs to undergo a hospital procedure and receive reimbursement in the form of “health aid”. SPEND PER YEAR: R$ 14.7 BILLION
The study “International benchmark on salary caps in the public sector”da and do ( – 8 MB – PDF), with data compiled from August 2024 to July 2025, indicates that the Judiciary and Public Ministry careers received R$14.7 billion in payments above the ceiling in the period of 1 year.
The limit imposed by the STF on penduricalhos and the five-year period, according to the Court, will provide savings of R$7.3 billion per year. This means that around R$7.4 billion will still be spent annually on these benefits.
