The Federal District sent a letter to the minister of the (Supreme Federal Court), asking for guidance on compliance with the decision to expel those due to the coup attacks of January 8, 2023.
The document, sent on the 25th, was obtained by the Panel. The officers have been imprisoned since March 11 in the so-called Papudinha, in , but the group also ordered the loss of public positions.
The situation of the five colonels today. While the troops fear that Moraes’ decision sets a precedent capable of shortening the rite of expulsion from the category, family members report anguish over the possible loss of retirement.
In the letter sent to Moraes, the PMDF reaffirms its “full and unconditional commitment to faithful and immediate compliance” with the decision, but says there is a doubt about the specific constitutional regime applicable to state and DF military personnel regarding the loss of rank and rank.
“The issue takes on particular relevance due to the condition of those affected — officers already inactive (paid reserve) —, a circumstance that recommends a more precise definition regarding the way in which the decision-making command is implemented, especially given the specificities of the legal-constitutional regime applicable to the category”, says the document.
“It should be noted that this statement is not aimed at re-discussing the merits of the decision, nor does it imply any conditioning to its compliance —already in progress—, constituting, merely, a measure of administrative caution aimed at its faithful execution, with due legal certainty and observance of the pertinent constitutional guidelines”, states the corporation, in another section.
On Wednesday (1st), the new general commander of the PMDF, Colonel Palhares, held a meeting with family members of the five convicts: Fábio Augusto Vieira, Klepter Rosa Gonçalves, Paulo José Ferreira and Marcelo Casimiro.
According to a participant who preferred not to be identified, the general commander reported having sent the letter to Moraes’ office, explained the rites that are already underway to comply with the decision and showed solidarity. There has still been no response from the minister.
The five military police officers convicted of the January 8 attacks held the highest rank in the Military Police, colonel. Two of them were general commanders of the corporation. They are all detained in the 19th Military Police Battalion, next to the Papuda Penitentiary Complex.
The five share the same space. The former president (PL), now under house arrest, was alone in a room next door. In a third cell, former Minister of Justice Anderson Torres and former director general of the PRF (Federal Highway Police) Silvinei Vasques are serving their sentences together.
