In relation to the other requests for redemption, the minister pointed out that the defense had not gathered the appropriate documentation
The minister of the Federal Supreme Court (STF), Alexandre de Moraes, determined on March 31st the 100-day reduction in the sentence of hacker Walter Delgatti Neto for his performance in the National High School Exam for people deprived of their liberty, the Enem PPL.
in São Paulo, where he is serving a sentence of eight years and three months for invasion, in 2023, of the National Justice Council (CNJ) systems at the behest of former federal deputy Carla Zambelli, currently imprisoned in Italy. On that occasion, the hacker inserted a false arrest warrant against Moraes.
The hacker’s defense had requested the remission of a total of 173 days of the sentence based on educational activities carried out in prison. In the request presented to the STF, the lawyers requested the conversion of 296 hours of training courses into 24 days of sentencein addition to a 16-day rebate for reading and writing reviews of four literary works, within the reading redemption program.
Furthermore, the lawyers requested a reduction of 133 days due to the prisoner’s performance in the Enem PPL 2025, an exam applied to people deprived of their liberty, arguing that passing the test generates the right to an additional discount on the time spent serving the sentence.
Moraes, however, accepted the opinion of the Attorney General’s Office (PGR) and set a 100-day remission for performance in the Exam. In the decision, Moraes stated that the extra benefit does not apply because Delgatti he already had completed higher education before entering the prison system.
In relation to other requests, the minister pointed out that the defense had not gathered adequate documentation to prove the hacker’s performance. In the case of redemption by reading, there was no proof that book reviews were evaluated and validated by the responsible commission, as required by the National Council of Justice.
As for the training courses, the certificates presented “do not prove the existence of authorization or prior agreement between educational institutions and the public authorities, nor do they detail the programmatic content and assessments, essential requirements to demonstrate suitability for the purposes of the Criminal Execution Law”, says the decision.
Therefore, the minister concluded that only the part relating to ENEM could be accepted at that time, also determining that new information be presented to re-evaluate the other requests.
Delgatti arrived at Tremembé Penitentiary 2 in February 2025 to serve the sentence imposed by the STF. In December of the same year, still in the closed regime, he was transferred to Penitentiary 2 of Potim, also in Vale do Paraíba. In January 2026, after Moraes granted progression to the semi-open regime, he returned to the Tremembé unit.
Before this conviction in the STF, Delgatti was already facing another case. In Operation Spoofing, he was sentenced in the first instance to 20 years in prison for hacking authorities from the extinct Operation Lava Jato and leaking illegally obtained messages. The case is still being processed in the second instance in the Federal Court in Brasília.
