Chamber approves rules for transition between governments – 04/07/2026 – Politics

This Tuesday (7) approved a bill that determines that the governor who leaves office must facilitate the transition process and share with the elected official “all the data and information necessary to implement the new government’s program.” Non-compliance will result in punishment. The text will still be analyzed by the Federal.

The project defines that the transition extends between the proclamation of the election results and the inauguration of the new ruler. After the results, both government members and the winners must designate the team responsible for exchanging information within 72 hours.

In case of non-compliance, administrative and legal sanctions, fines and the obligation to repair damages are foreseen.

Sanctions will be increased by one third in the case of deliberate withholding of information, destruction of databases or IT equipment or damage to material or immaterial public property, with the aim of hindering the transition, intimidation of a public servant or agent and generation of irreparable or irrecoverable damage.

The proposal determines that members of the transition team will not receive extra remuneration for carrying out their activities.

Deputy Chico Alencar (PSOL-RJ), author of the text, defended the proposal in the plenary, which he named “law against the evil loser of the elections”.

“The project is civilizing, so that the outgoing head of the Executive Branch and the incoming head of the Executive Branch and their respective teams make a transition with reliable data, with teams not paid for this function, equally reliable, with technical competence, with data transparency”, he argued.

The approved text was the substitute prepared by the Labor, Administration and Public Service Commission, dated 2007.

Two sub-amendments of the 2009 CCJ (Constitution, Justice and Citizenship Commission) were also approved. The final wording will still be prepared by the CCJ. Afterwards, the text will go to the Federal Senate.
