The Constitution, Justice and Citizenship Committee of the Chamber of Deputies approved a bill that creates a new mechanism for the acquisition of health technologies by the SUS (Unified Health System) – the managed access agreement.
According to the approved text, the managed access agreement conditions the acquisition of new technologies to continuous monitoring by the government, allowing the shared management of associated clinical and financial risks.
The new model provides for 4 types of agreement:
- financial-based;
- based on clinical performance;
- hybrids; and
- of risk sharing.
According to the approved text, the managed access agreement will be signed between the government and companies, according to the specific contract. Responsibility will be shared, with criteria, deadlines and third-party participation defined.
PROPOSAL
On the recommendation of the rapporteur, deputy Diego Garcia (Republicanos-PR), the Health Commission’s version of Bill 667 of 2021, by deputy Eduardo da Fonte (PP-PE), was approved. The rapporteur made adjustments to the wording.
“The substitute is limited to conceptualizing managed access agreements, indicating their objectives and possible models and, above all, providing the Executive Branch with the decision to enter into such agreements”stated Diego Garcia in the approved opinion.
How was it analyzed in conclusive characterthe proposal may go to the Senate, unless there is an appeal for analysis in the Chamber plenary. To become law, the final version of the text must be approved by both Houses.
