Fachin says that the Judiciary is experiencing a crisis and defends the STF’s self-restraint

President states that the expansion of the Judiciary requires reflection on limits and a critical stance

The president of, , stated, this Friday (April 17, 2026), that the Judiciary is experiencing a crisis and needs to reflect on the limits of its actions. The statement was made during a lecture at , in São Paulo.

“We are immersed, in relation to the performance of the Judiciary, in a crisis that needs to be faced“, he said. According to the minister, the scenario requires attention to avoid inappropriate solutions. “Under penalty of repeating, for new problems, old solutions”he stated.

Fachin defended that the expansion of the Judiciary Power must be accompanied by limits. “Any expansion of power, even if well-intentioned, needs to be accompanied by self-restraint and critical reflection”he declared. He added that the STF must maintain a reflective stance regarding its own actions.

The minister used a metaphor to illustrate the argument. “The Judiciary needs to place a mirror in front of itself in which it can see itself to see possibilities and also its limits”he said. He also stated that the country lives “times of institutional distrust” and polarization.

Commenting on recent tensions, the president of the STF between Powers and defended the use of legal mechanisms for contestation. “When you do not agree with a decision, the appropriate path is to appeal, and not to attack the institutionality itself”he said. He further stated that the court will provide answers “in a united and collegial manner”.
