Sindienergia calls MPF and asks for suspension of capacity auction

Sindienergia-RN filed a representation with the MPF (Federal Public Ministry) asking for the suspension, alleging “serious irregularities and inconsistencies” in the planning, parameterization and execution of the event.

In the document, the entity states that there is a risk of collective damage of great magnitude and requests the adoption of precautionary measures to prevent the approval and signing of contracts until the legality of the auction is analyzed.

The representation increases institutional pressure on the auction, which is already under analysis by the TCU (Federal Audit Court). One of the main points raised is the cost of the event. According to Sindienergia, the auction can generate a minimum liability of around R$517 billion throughout the contracts, considering only the plants’ fixed revenue. In higher dispatch scenarios, the total value could exceed R$800 billion.

The entity also points to a significant increase in the Capacity Reserve Charge (ERCAP), which could jump from approximately R$7 billion to R$51 billion per year, with a direct impact on energy tariffs.

The document lists a series of possible flaws in the auction design, including the accelerated review of ceiling prices, with increases of up to 100% in a few days, based on data provided by interested agents themselves.

For the union, this movement may have compromised competition, resulting in a low average discount of 5.52%and bids close to the maximum values ​​allowed.

The representation also cites a concentration of winners and questions whether the contest fulfilled its function of selecting the most advantageous proposal for the system.
