The prosecutor: “The purchase of masks from Management Solutions was irregular because other offers were not considered”

In his reading of conclusions, prosecutor Alejandro Luzón has stated that the purchase of masks for the Ministry of Transport was irregular not because of the procedure – there was none, as it was an emergency situation – or because of the price – due to the market situation, there was no reference price, Luzón explained – but rather that “the Ministry, led by José Luis Ábalos, closed itself to new offers that were arriving”, and they were not taken into consideration because “there was already a previously closed agreement established with Víctor de Aldama that could not be modified.”

Furthermore, he has said that the illicit conduct attributed to the accused is “the existence of a prior and privileged agreement with Aldama”, which he considers proven because Aldama says so, because the ministerial purchase order “is issued long after the agreement” and because “the number of masks is decided by the company according to its wishes, not the needs of the administration.”

In this matter, he considers important “the inappropriate decisive role that Koldo García assumes in the processing of this of these contracts.” The different reports, the prosecutor argues, “agree on the distortion that throughout the process he says has been represented by the excess of powers recognized de facto to an assistant to the minister, very far from his own work in terms of promoting management contracting procedures and which exercised direct undue influence on contracting bodies.”
