The federal deputy (Missão-SP) proposed establishing a limit for the charging of annual fees by federal councils, including the (Brazilian Bar Association).
He presented a bill and, even in an election year, hopes to approve the text. The proposal establishes a ceiling of R$250 for higher education professionals. For technical level professionals, the ceiling will be R$125.
The text wants to change a 2011 law that already established a charging ceiling of R$500. The deputy’s justification is to establish a ceiling for annual fees, regardless of profession.
The project is filed less than three months after the (Supreme Federal Court) decided that lawyers do not need to respect the previous ceiling. A decision taken at the end of February says that they follow the rules of the OAB statute
According to Kataguiri’s project, companies with capital of up to R$50,000 will pay up to R$250. With larger capital, they will pay up to R$500. The text also establishes progressive ranges, allowing a maximum limit of R$2,000 for companies with capital above R$10 million.
In his justification, the parliamentarian criticized the amount raised by the councils. According to him, the entities have already moved more than R$6 billion.
“The absence of an express legal limit generates disparities in charging, with sections charging amounts close to R$1,000 annually,” he says.
