Congressmen call for non-renewable energy sources in Redata

Manifesto launched by parliamentary fronts this Tuesday (May 12) calls for the project to include non-intermittent sources

Congressmen and members of the energy, technology and infrastructure sectors demand that the bill that establishes Redata (Special Taxation Regime for Datacenter Services) includes some types of non-renewable energy sources, such as natural gas and nuclear generation.

The text being processed in Congress creates tax incentives for companies that install or expand data center operations in Brazil and meet a series of criteria that include the use of clean energy, production for the domestic market and investment in research.

Launched this Tuesday (May 12, 2026) by 10 parliamentary fronts and 26 entities from the productive sector, the “Manifesto for the approval of Redata and for the digital future of Brazil” asks that the text extend benefits to data centers that use energy sources not subject to intermittency –that is, that they provide uninterrupted supply. To meet this demand, the project would have to allow for non-renewable sources. Read the document (PDF – 727 kB).

The current text that has already passed the Chamber and awaits analysis by the Senate says that incentives will only be granted to operations that meet the totality of your electrical energy demand com “supply or self-production from generation from clean or renewable sources”.

It turns out that sources such as wind and solar, two of the most used in the data center segment around the world, are intermittent, that is, they depend on environmental variables and do not ensure constant supply throughout the day. It is common for this type of enterprise to include secondary systems with other types of supply for emergency situations or supply interruptions.

Data centers need to work uninterruptedly because they store and process data from websites, social networks and artificial intelligence systems. Therefore, the signatories of the manifesto warn of the need to ensure availability of “firm, continuous and reliable energy”. According to the document, including other types of energy in Redata will reduce possible operational risks, increase the reliability of the system and provide greater security for investors.

The manifesto does not specifically mention any energy source. The expectation is that this will be negotiated when the project is regulated, but Tatiana Ribeiro, director of (Movimento Brasil Competitivo), which is leading the process, talks about including in the project the possibility of supplying natural gas, a source with much lower carbon emissions than traditional ones. The idea is that it will be used as contingency systems in case of intermittence. Another proposal from the signatories of the manifesto is biomethane, a firm and renewable energy source.

According to the executive, negotiations are already underway in the Senate for the change to be included in the text. Members of the initiative are also negotiating with the government to maintain the release if the project passes the Casa Alta.

President of the Mixed Parliamentary Front for Competitive Brazil and one of the leaders of the manifesto, deputy (PP-RJ) presented an amendment to include natural gas, biomethane and nuclear energy among the sources capable of supplying energy to the beneficiary data centers. THE MANIFESTO

The document was released to increase pressure for deliberation and approval of the text, which has been at a standstill and without an agreement in the Senate since February. The assessment of members of the initiative is that Brazil is losing investment in the sector due to the delay in analyzing the proposal. Technology companies are following the project’s progress with interest and are already discussing with their headquarters how to bring investments to Brazil.

Initially, Redata by MP (provisional measure) 1,318/2025, published by the government in September 2025. To gain definitive validity, the text would have to be approved by Congress by February 25, but .

Before the text expired, the deputy (PT-CE), then government leader in the Chamber, presented PL 278/2026 to replace the provisional measure. The objective was to prevent investments made during the term of the text from being harmed. The text by the deputies in the early hours of February 25th and is now awaiting analysis by the senators, but it is stuck in the Upper House.

WHAT THE REDATA SAYS

The PL establishes the suspension of the payment of federal taxes on the acquisition, domestically or by import, of equipment and technology components used in data centers. Read the of the project (PDF – 138 kB).

Among the taxes covered are the Import Tax, the IPI (Tax on Industrialized Products), the Contribution to PIS/Pasep and Cofins, including on import operations. In practice, these incentives significantly reduce the initial cost of which today represents one of the main barriers to the installation of these infrastructures in the country.

According to the project, the suspension of taxes will be converted into a zero rate after compliance with a series of conditions established in the regime. Once investment requirements in R&D, sustainability, clean energy and capacity availability for the domestic market have been met, the equipment acquired will have definitive exemption these taxes, making Brazil more competitive in relation to other countries that .
