Toffoli says Cortes defends rights “of the poorest”

STF Minister said that laws exist to protect freedom, equality and solidarity, especially the most vulnerable

The minister of the Federal Supreme Court, , stated this Wednesday (May 13, 2026) that the constitutional courts have guaranteed the maintenance of rights “of the poorest”. The statement was given during the opening of the 16th Ibero-American Conference on Constitutional Justice, held at the headquarters of the STF, in Brasília.

According to Toffoli, constitutional courts began, from the end of the 20th century, to play a central role in enforcing fundamental rights and defending the Democratic Rule of Law.

“The constitutional courts are giving effect to maintaining people’s rights and especially the rights of the poorest”these.

The minister also stated that “the law exists to defend the poor” and to ensure “freedom, equality and solidarity, especially for those who need it most”.

During the speech, Toffoli said that institutions and courts have been the target of attacks for seeking to give effect to constitutional texts. According to him, this is one of the main challenges faced by courts in a digital environment.

“Our commitment is to give effect to the text of the Constitution so that it is not what Lassalle said: that it was nothing more than a sheet of paper”he stated.

The minister also declared that constitutional courts have the function of guaranteeing the preservation of the Democratic Rule of Law in a context of rapid technological and political transformations.

It brings together representatives of supreme courts and constitutional courts from countries in Latin America, Europe, Africa and the Arab world. The event continues until Thursday (May 14).
