The minister Alexandre de Moraes, from the Federal Supreme Court (STF), released for trial the criminal action in which the former federal deputy Eduardo Bolsonaro (PL-SP) is accused of promoting tariffs in the United States against Brazilian exports. The date for analyzing the case has not yet been defined.
O case will be judged by the First Panel of the Courtwhich is also made up of ministers Flávio Dino, Cristiano Zanin and Cármen Lúcia, in addition to Moraes, rapporteur of the process.
In November last year, the investigation that investigated the former parliamentarian’s actions with the United States government to promote tariffs against Brazilian exportsthe suspension of visas of federal government ministers and court ministers. He is responsible for the crime of coercion during the process.
Since last year, Eduardo Bolsonaro is in the United States and lost his parliamentary mandate for missing sessions of the Chamber of Deputies.
Before releasing the case for trial, Alexandre de Moraes ordered the notification of the former deputy by noticebut he was not found nor appointed a private lawyer.
Given the situation, the minister authorized the defense to be carried out by the Federal Public Defender’s Office (DPU).
In the final arguments presented to the Supreme Court, The body defended the annulment of the process and said that Moraes cannot judge the case for being a victim of visa cancellation and financial sanctions arising from the Magnitsky Act.
“Here the Judge is, at the same time, the main victim of the conduct he is called to judge”, said the DPU.
According to the accusation made by the PGR, Eduardo encouraged the actions of the United States to try to prevent the Supreme Court from convicting former president Jair Bolsonaro in the coup plot process.
“It was proven that the defendant deliberately used serious threats against the authorities responsible for the trial of AP 2,668, some of which were carried out, in order to favor the interests of his father, freeing him from any criminal liability”, argued the prosecutor.
