Fachin speaks to UN rapporteur about ‘external pressure’ – 06/02/2026 – Brasília Hoje

The president of the (Supreme Federal Court), warned the (United Nations) about “external pressures” suffered by the Brazilian Judiciary and said that this requires “increased attention” from democratic institutions.

Fachin spoke about the subject this Tuesday (2), in a private meeting at the Supreme Court with Margaret Satterthwaite, UN special rapporteur on the issue of the independence of magistrates and lawyers.

the STF and the federal government are evaluating measures to protect the minister, after the Trump Media group and the platform notified the judge about a lawsuit filed against him in the .

The lawsuit pending in the District Court of Florida asks that Moraes be held accountable for decisions that were interpreted as “gag orders” and censorship against American companies and citizens.

To the UN rapporteur, Fachin expressed concern about “unilateral sanctions that would aim to affect judicial independence”. He also said that these initiatives seek to “embarrass magistrates due to acts carried out in the regular exercise of their functions”.

According to information from the STF Communication Secretariat, “the minister was clear in saying that the challenges currently faced cannot be underestimated”, but considered that he has confidence in the ability to react “firmly and effectively to threats”.

Fachin also reiterated that international cooperation is essential to defend the “democratic values shared by nations committed to the protection of human rights and constitutional institutions.”

After Moraes was notified by Rumble, the president of the STF is examining the appropriate legal mechanisms to preserve the court’s autonomy. The measures are being discussed with the (Attorney General of the Union) and the .

The initial assessment is that a Brazilian judge cannot be personally responsible for decisions made in the exercise of his position, as the national legal system protects judicial independence.

A minister heard by the Sheet states that an order issued by a member of the STF, even if monocratic (individual), is an institutional decision and cannot be interpreted as the personal point of view of the person who signs it.

Furthermore, this magistrate observes that the majority of Moraes’ decisions have been endorsed by a collegiate body — that is, if a case against the rapporteur was applicable, it would also be possible against all the others who voted in the same direction.

People close to Fachin also point out that the Organic Law of the Judiciary and the CPC (Civil Procedure Code) only provide for the judge’s personal liability in exceptional cases, such as when he acts in office through fraud or fraud.

It revolves around a decision made by the minister for Rumble to permanently close the account of Bolsonarist Allan dos Santos and prevent the creation of new profiles.

As Rumble did not comply with the decision, the STF minister ordered, in 2025, the video platform to be suspended throughout Brazil. The platform’s lawyer, Martin De Luca, claims that Moraes acted illegally, without a legal basis.
