‘Concern’, says STF about Italian court saying that Moraes was partial to Zambelli

The Federal Supreme Court (STF) stated that which pointed out minister Alexandre de Moraes’ partiality after the trial of former federal deputy Carla Zambelli (PL-SP).

According to the body, the process followed the Constitution, and the Court acts with authority when examining extradition requests.

“The process and its acts took place in strict compliance with the Constitution of the Republic, due legal process, the adversary system, broad defense and international commitments assumed by the Brazilian State”, says the text.

The note ends by saying that the authority of judicial decisions and the independence of the Judiciary are a non-negotiable constitutional duty of the STF.

Conviction

Zambelli was convicted of invasion of the National Justice Council system (CNJ) and by carrying an illegal firearm in the 2022 elections.

At the behest of the former deputy, hacker Walter Delgatti Neto inserted a false arrest warrant against minister Alexandre de Moraes in the justice system. “Let the arrest warrant be issued to the detriment of myself, Alexandre de Moraes. Publish it, summon it and make the L”, said the fake document.

For the Italian Justice, Moraes incurred an “atypical accumulation of judicial functions” by leading part of the investigations and being the judge responsible for analyzing the merits of the case.

“It appears from the documents transmitted that MADM was designated as rapporteur of the criminal proceedings to the detriment of ZSOC (Zambelli); in this capacity, he participated in the decision of the preliminary questions, including the one relating to his incompatibility, as well as the decision to condemn the appellant in relation to the crimes charged and the one that determined the immediate loss of ZSO C’s parliamentary mandate; the same Judge, in addition, issued the arrest warrant against ZSOC, wrote the extradition request and provided information about the Prison”, he says.

The Court of Cassation annulled, on May 22, the extradition of the former federal deputy. . She published a video on her husband, Coronel Aginaldo’s Instagram profile, accompanied by him and lawyer Pieremilio Sammarco.

“Today is May 22, 2026, Saint Rita’s day, named after my mother and the person who was my cellmate,” said Zambelli.

The process still depends on a decision by Italy’s Minister of Justice, Carlo Nordio. The minister has a period of 45 days to express his opinion following the Court’s new decision.

Before this Friday’s decision, the Italian court had been making decisions in favor of Zambelli’s extradition in the two cases in which she was convicted before the STF. The defense then appealed to the Court of Cassation, which is the last instance of justice in the country. Zambelli had his parliamentary mandate revoked by the São Paulo electoral court in 2025.
