Henry case: Monique’s defense leaves case amid dispute over pardon

Lawyers Florence Rosa and Amanda Melo announced on Thursday (11), that left the defense of Monique Medeiroswho was accused of the death of her son Henry Borel, aged 4, and .

Florence stated that she intended to continue defending Monique at the appeal stage; however, the arrival of a new lawyer to the team and a “legitimate incompatibility of defensive strategies” made her choose to leave the case.

“Disagreement regarding technical conduct is a natural circumstance in the practice of law, and strategic coherence is a prerequisite for full defense. We register our respect for the customer and the hope that his defense continues with all zeal”, he stated in a post on social media.

Lawyer Florence was one of those responsible for supporting Monique’s defense in the longest Jury Court in the history of Rio de Janeiro. There were 11 days of testimony and debates between the prosecution and defense of Henry Borel’s mother and former councilor Jairo Souza Santos, known as Jairinho. The former parliamentarian was sentenced to 43 years for the child’s death.

Already Amanda Melo stated that her participation in the case occurred through hiring and acting in partnership with Florence.

“On our part, there was a willingness to continue in the appeal phase, due to the pending appeal. However, given the appointment of a new defender, the adoption of a new defensive strategy and the termination of Dr. Florence Rosa’s role in the case, my participation in the case also ends”, he wrote on social media.

She was held responsible for omission in only one case of torture against her son. The sentence, of 1 year and four months, however, has already been served by the teacher. Henry’s father, Leniel Borel, must receive compensation for moral damages of R$400,000, to be paid by Jairinho.

“Since the investigation, Monique did not deserve the benefit of the doubt and throughout the processalthough she was identified as a zealous mother, and was not accused of directly inflicting physical aggression on her son, the revolt quickly evolved into an outright massacre on social media, with attacks much more virulent than those directed at the direct author”, stated the judge during the sentencing.
