Dino says that foreign courts do not always act on the principle of reciprocity

The Minister of the Federal Supreme Court (STF) Flávio Dino stated this Tuesday (16) that decisions from foreign courts do not always observe the principle of reciprocity adopted by Brazilian Justice. The statement was made a few days after the highest court in Italy rejected the extradition of former deputy Carla Zambelli.

Dino addressed the issue during the trial that resulted in the conviction of former deputy Eduardo Bolsonaro for coercion during the process. When commenting on the Supreme Court’s relationship with courts from other countries, Dino said that the Court has a tradition of acting “deeply deferential to the jurisdictions of other countries”, and that “sometimes the same doesn’t happen” in relation to Brazilian decisions.

“This Supreme Court, with great speed and promptness, examines requests for preventive detention and extradition, and we never put ourselves in the position of judges of other judges in other countries. On the contrary, we have a comprehensive attitude towards the multiplicity of legal systems existing in the worldexcept in extreme cases, in which basic prerogatives are not met”, he declared
