PT deputy asks Moraes to send Bolsonaro back to jail

The federal deputy and deputy leader of the government in the Chamber, Lindbergh Farias (PT-RJ), asked this Wednesday (17) the minister of the Federal Supreme Court (STF) Alexandre de Moraes to revoke the house arrest of former president Jair Bolsonaro and send him back to jail.

The request was made on Monday (15), during a routine blitz carried out in Taguatinga, Brasília. During the approach, the weapon was in the possession of a soldier assigned to the Institutional Security Office (GSI), who was driving the vehicle. The occurrence was initially recorded by the Metrópoles portal and confirmed by Young Pan.

“In view of the news of the seizure of a firearm belonging to the convict, as well as the confirmation, by the defense itself, that the convict kept it at his residence during the period of house arrest, a reevaluation of the measure is required, with the return to the closed regime”, argued the deputy in a document sent to Moraes.

For the parliamentarian, the problem is not only knowing whether the weapon was registered, but also the fact that the convict, who is under house arrest, cannot keep, in the same place where he is in custody, a firearm. “House arrest remains prison. The residence, while the measure lasts, is not just a private home: it is the judicially defined space for the fulfillment of custody”, he wrote.

The former president’s defense admitted this Wednesday that when it was seized, the deputy, however, said that it was not sufficient justification, as possession “involves the custody, availability, circulation and possible recomposition of a firearm in the custody environment”.

Finally, he requested that the Attorney General’s Office (PGR) comment on the request, in view of the incident involving the seized weapon. “For the demonstration about the non-compliance with the material conditions of house arrest, the need to revoke the measure and, alternatively, the impossibility of its renewal at the end of the 90-day period”, he added.

If the revocation of house arrest is not granted, he requests that the “loss of trust and material incompatibility” be sufficient reasons for Bolsonaro to do not continue to serve time at home.
