For the Federal District Court, the platform failed to promptly respond to the request for self-exclusion from a military police officer diagnosed with gambling disorder
The Federal District Court ordered a company that owns an online betting platform to return R$180,000 to a compulsive gambler who did not have his self-exclusion request responded to promptly. In addition to returning the amount, the company SevenX Gaming SA, operator of Bullsbet, will have to pay compensation of R$4,000 for moral damages. The decision is from the 3rd Civil Panel of the TJDFT (Court of Justice of the Federal District and Territories). Here is the decision (PDF – 430 kB).
According to the decision, the gambler who developed an addiction to gambling (ludopathy) is also diagnosed with ASD (Autism Spectrum Disorder). A retired military police officer, he said he stepped up his bets after receiving information through targeted advertisements. According to him, the bets made him accumulate more than R$375,000. These reasons led the Court to annul the validity of the bets.
“In January 2025, he spent R$180,963.12 on betting, which worsened his debt and led him to take out several loans totaling more than R$375,000.00, in addition to financially compromising his father, who sold a property to help him.”, states the Justice.
The decision of the rapporteur, judge Roberto Freitas Filho, is based on article 26 of the Civil Code. The legislation prohibits the participation of people diagnosed with gambling disorders in betting systems, when the condition is proven by a report from a mental health professional.
The judge considered that there was a failure in the provision of the service by Sevenx Gaming SA. The bettor demonstrated that he had requested the definitive blocking of the account via the platform’s chat. He informed his dependence, but the request was ignored.
According to the ruling, the conduct violated Ordinance SPA/MF 1,231 of 2024, which obliges operators to guarantee immediate self-exclusion mechanisms.
OTHER SIDE
In its appeal, Sevenx Gaming alleged passive illegitimacy. He said that the website only started operating in January 2025 and that the user declared that he did not have the disease at the time of registration. The company also stated that it adopts “responsible gaming“.
The 3rd Civil Panel rejected the arguments based on the assertion theory and joint liability provided for in the CDC (Consumer Protection Code). For the judges, business succession does not eliminate responsibility for damages caused to the consumer.
