Cade prohibits sponsors from “disrupting” the departure of FFU clubs

Preventive decision in the body met representation of the CSA of Alagoas; club talks about “competitive concerns”

The general superintendent of Cade (Administrative Council for Economic Defense), Alexandre Barreto de Souza, issued a technical note prohibiting the league’s main sponsor (Futebol Forte União), the Sports Media Entertainmentto create obstacles for clubs to leave the league. The technical note was signed on Thursday and Friday (June 25th and 26th, 2026). It has a preventive and administrative nature. Here is it (PDF – 61 kB).

The technical note was issued in response to a representation made by the (Centro Esportivo Alagoano) of Alagoas to the body. Headquartered in Brasília, Cade’s role is to protect free competition and combat abuses of economic power.

In the document, Barreto says that the CSA states that the FFU and Condomínio Forte União “cwould create obstacles to the exit of associated clubs, restricting their ability to migrate to other existing or future associative arrangements, especially to the Brazilian Football League (Libra)“, it says.

It is concluded that the coexistence of different leagues focused on collective negotiation of broadcasting rights generates a competitive dynamic between these arrangements for attracting and maintaining the clubs that make up them. From this perspective, possible mechanisms designed to prevent or artificially hinder the migration of clubs between competing leagues may raise concerns from the perspective of competition protection, as they reduce market contestability and limit the competitive dynamics between these structures.”, stated the superintendent.

No dispatch, determines that Sports Media Entertainment “refrain from creating obstacles”, under penalty of a daily fine of R$250,000.

Condomínio Forte União is the legal structure of the League. It was established on October 31, 2023 for the collective exploitation of arena rights and commercial properties of clubs in Series A and B of the Brazilian Championship. Its objective is to professionalize the negotiation of broadcasting rights, improve revenue sharing and capitalize on clubs through a strategic investor. Atlético Mineiro, Corinthians, Fluminense, Cruzeiro, Vasco da Gama, Internacional and Botafogo are among the Serie A teams that make up the group.

Sports Media Entertainment received, with surprise, the news of the decision-making order from the then General Superintendent of Cade, in Procedure No. 08700.003201/2026-21, especially as it was issued even before the end of the period granted for the presentation of information and as part of an absolutely preparatory procedure. The SME was not even regularly notified of the decision. However, it is understood that this is a decision without relevant practical effects, the result of an incorrect understanding of the facts.

It should also be noted that, in the very reasons for the decision, it is expressly recognized that the property rights and financial obligations arising from the signed contracts remain intact and fully enforceable, safeguarding the rights acquired by the company within the scope of the investment agreement.

Sports Media Entertainment expresses full confidence in Cade and that, after presenting the clarifications and full analysis of the facts, the decision will be promptly reviewed by the Authority itself, in order to adequately reflect the legal and competitive aspects involved.”

O Poder360 contacted the CSA to ask if they would like to comment on the issue, through messaging applications and the official Instagram profile, at 1:38 pm. An email was also sent at 3pm.
