The Prosecutor’s Office asks the hearing to order the deletion of Garzón’s background | Spain

The Prosecutor’s Office has asked the Contentious-Administrative Chamber of the National Court that orders the Ministry of the Presidency, Justice and Relations with the Courts to delete the criminal records of Baltasar Garzón, who a magistrate force instructor of the National Court, for prevarication for the recording in prison of the conversations of the main leaders of the Gürtel case. The Public Ministry takes this step in a process promoted by the exjuduez himself due to the lack of administration’s response to his claims following an opinion of the UN Human Rights Committee, objectively justified that he had “access to an independent and impartial court”.

The UN Committee urged the Spanish State to provide. As the Public Ministry recalls in a letter signed by prosecutor Manuel Campoy, this body considered that the criminal record should be deleted; give it an “adequate compensation for the damage suffered”; “Adopt measures to prevent similar violations from committing in the future”; and “publish” both the opinion and the decision of admissibility of the committee, with the intention of giving them “broad dissemination.”

Such obtaining that victory in 2021, Garzón asked justice to fulfill the opinion of the UN Human Rights Committee. He requested it in January 2022. He reiterated it in February of that same year. And he claimed it again in January 2025. But he has always obtained the same answer: administrative silence. Then, the ex -marker went to the courts.

Now, in this process by means of the contentious-administrative, the Prosecutor’s Office has been interested in ordering the Ministry to “comply with and implement the conclusions and determinations of integral reparation” set by the UN Human Rights Committee.
