Anticipation remains on hold until there is a final decision on the process that could lead to the expiry (or termination) of the current contract
The São Paulo Court responded to the request of the mayor of the capital of São Paulo, , and ordered the immediate suspension of the process of early extension of the concession contract for . The decision was taken this Thursday (9). According to the document, to which the column had access, the anticipation is stopped until there is a final decision on the process that could lead to the expiration (or termination) of the current contract.
“I partially grant the urgent relief requested by the Municipality of São Paulo to determine the immediate suspension of the administrative process for the early extension of Enel’s concession contract until a definitive decision is made in the process that may result in the expiration of the current contract, as well as the assessment of satisfactory compliance with the supervisory and sanctioning measures imposed.’
Furthermore, the judge ordered the National Electric Energy Agency (Aneel) to send, within five days, the full administrative process informing if there is a new decision and ordered the regulatory body to technically assess whether Enel provides “adequate service”, considering relevant climate events between 2023 and 2025 and indicators.
In the decision, judge Maurílio Freitas Maia de Queiroz reaffirms that the concession of electricity is the responsibility of the Union and Aneel, but admits the legitimacy of the municipality in protecting the local collective interest. He also recalls what he called Enel’s “repeated failures”, with “fines of R$320 million, recurrence of blackouts in 2023 and 2024 and lack of proof of improvements”.
