Lawyer Mônica Rosenberg filed a lawsuit with the Public Finance Court against the Municipality of São Paulo to serve as an advisor in the Institutional Relations department of the City of São Paulo.
In her petition, filed on Wednesday (22), the lawyer, who is Jewish, asks for an injunction that suspends the effects of the appointment.
and in the second instance, for insulting and practicing racism against the Jewish community.
Despite the conviction, the appointment was published in the Official Gazette last Wednesday (15). Rosenberg files the lawsuit against the city hall, the mayor () and Amadeu himself.
According to her, the appointment is an affront to the constitutional principle of administrative morality and is in disagreement with the Clean Record Law, which prohibits the occupation of public positions by people with convictions in the second instance.
“When someone convicted of racism is appointed to a position of trust, what is shaken is not only the law, but society’s own trust in public authorities”, says the lawyer.
Rosenberg also states that “by admitting the unacceptable, the city hall encourages other people to come out of the closet with their prejudices and violence and communicates that its doors are open to those who practice hatred.”
The action has not yet been decided. Judge Liliane Keyko Hioki, from the 6th Public Finance Court, granted time for the city hall and Public Prosecutor’s Office to comment on the case.
The Nunes administration has already stated to the Panel that the sentence has been prescribed and, therefore, there is no impediment for Amadeu to take up the position. The city hall also informed that the former councilor will be assigned to the Municipal Secretariat of Institutional Relations given his political experience.
The prescription of serving the sentence, however, does not eliminate the conviction, nor its legal effects.
Amadeu was subject to an open regime and paid a fine of 13 minimum wages.
One of the lawsuits, filed by the Israeli Federation of the State of (Fisesp), mentions the fact that he cited in an audio message the “shamelessness” of the Jews at Albert Einstein Hospital for their behavior during the pandemic.
In the other action, he was sentenced to one year and four months in prison after calling then-councilman Daniel Annenberg a “Jew, son of a bitch” and a “shit Jew”, during the discussion of a project at the City Council on December 11, 2019.
The sentences, in both cases, were replaced by community service provision and payment of compensation.
