Eduardo Tagliaferro is accused of leaking confidential information and being part of a scheme that attempted to delegitimize institutions
The First Class of (Federal Supreme Court) formed a majority to make the defendant the former advisor of , accused of leaking confidential information and working in conjunction with anti-democratic groups. The minister’s vote followed those of Alexandre de Moraes, rapporteur of the case, and forming a 3-0 majority so far.
The minister’s vote still remains who has until midnight on Friday (14.Nov.2025) to register his position in the virtual plenary. If a minister requests a view (more time to analyze the process) or a highlight (to take the discussion to the physical plenary), the analysis may be suspended.
The complaint against Tagliaferro was filed by (Attorney General’s Office), headed by and cites 4 crimes:
- breach of functional secrecy;
- coercion during the process;
- obstruction of an investigation involving a criminal organization;
- attempted violent abolition of the Democratic Rule of Law.
According to Moraes, the former advisor would have reinforced a “campaign to delegitimize institutions” by leaking confidential messages and data from investigations conducted at the STF and the (Superior Electoral Court).
Tagliaferro was chief advisor of the Special Advisory for Combating Disinformation, the area responsible for monitoring attacks and fake news against the Judiciary.
According to the Federal Police, he replicated confidential messages to the press, with the aim of creating political embarrassment and favoring groups linked to the coup plot investigated in the fake news and digital militia investigations.
In February 2024, the PF indicted the former advisor for breach of functional confidentiality, and in August, the PGR formalized the complaint. Before that, Tagliaferro fled to Italy in July and even threatened to reveal behind-the-scenes information about Moraes’ office. In October, in Italy after the minister requested his extradition.
An extradition hearing was scheduled for December 17th by the Italian court.

If Carmen Lúcia requests to be seen or highlighted, the analysis may be suspended or transferred to the physical plenary. With the conclusion of the trial, the decision to accept the complaint will be formalized.
With the acceptance of the complaint, Tagliaferro will be officially cited in Brazil, even though he is imprisoned in Italy, and will be able to present his preliminary defense. This is the moment when the accused has the chance to contest the accusations or question the legality of the process.
The STF will then begin the criminal investigation phase, in which evidence, leaked messages, Federal Police documents and witness statements will be analyzed. After this stage, the Court will be able to judge whether he is guilty of the 4 crimes mentioned in the complaint.
Even after a possible sentencing trial, Tagliaferro will be able to appeal within the STF itself and question aspects related to extradition or the conduct of the process.
