The Minister of the Federal Supreme Court (STF) Flavio Dino said this Thursday (12) that, in a democracy, a “silenced and gagged” judicial system is not possible.
He cited the criticisms made to the Court regarding possible “activism” in the actions of ministers. Dino participates in a “Conselhão” meeting chaired by the vice-president and minister of Development, Industry, Commerce and Services, Geraldo Alckmin (PSB).
For Dino, the Judiciary “is not a political and elected power”, but there is “valuation” of dialogue with society. “No judgment relevant to Brazil is made without dialogue with society, be it amendments, budget, environment”, he stated.
Dino is the rapporteur for an action at the STF that demands transparency and traceability for parliamentary amendments. The Court’s decisions in this area have generated friction between the Three Powers. At the beginning of the week, the minister rejected a government request to relax the rules imposed for transfers, seen as excessive by parliamentarians.
The judge mentions that criticism about the Court’s possible “activism” usually comes from “those who don’t like the Supreme Court’s decisions”.
