Who is entitled to receive
Insured persons who won legal action against the INSS linked to the granting or review of benefits, such as:
- retirements (by age, contribution time, disability or person with a disability);
- death pension;
- benefit for Temporary Disability (former sickness benefit);
- BPC (Continuous Payment Benefit).
To receive this payment, you must:
- the process is completely closed (has become final);
- the value is up to 60 minimum wages (R$91,080 in 2025);
- the judge’s payment order was issued in November 2025.
Payments are made through RPV (Small Value Requests), a mechanism used to settle court debts of lower value in a shorter period of time than traditional court orders.
When the money falls into the account
RPVs must be paid within 60 days of the judge’s payment order. The deposit is made into an account opened at Banco do Brasil or Caixa, in the name of the beneficiary or his lawyer.
Before payment, the process goes through a processing phase, when accounts are opened. After the deposit, the court system starts to indicate the status “Paid in full to the court”.
How to know if you will receive
The query must be made on the website of the TRF (Federal Regional Court) responsible for the process. You can search using:
- CPF (Individual Person Registry) of the beneficiary;
- process number;
- lawyer data, such as registration number with the OAB (Brazilian Bar Association).
In the “Value entered in the proposal” field, the amount to be paid appears. The acronyms indicate the modality: RPV or precatório.
Difference between RPV and precatório
Here’s what makes them different:
- RPV – up to 60 minimum wages, paid within 60 days after the court order;
- precatory – above this limit, paid once a year. The 2025 federal court orders were released in July.
Heirs
Heirs of dead beneficiaries are entitled to the arrears, as long as they prove the legal link and qualify in the process. In case of doubt, the advice is to contact the lawyer involved in the action or the Federal Public Defender’s Office.
