The statement was sent after an order from Moraes that gave 24 hours for clarification under the risk of preventive detention
The defense of Filipe Martins, former international advisor to Jair Bolsonaro (PL) serving 21 years in prison, told the Federal Supreme Court that he never used the social network LinkedIn. The statement was sent this Wednesday (Dec 31, 2025), after minister Alexandre de Moraes 24 hours for clarification under the risk of preventive detention. Here is it (PDF – 464 kB).
The petition responds to Moraes’ order issued on Tuesday (Dec 30, 2025), after the case records recorded information that the defendant had accessed LinkedIn to consult third-party profiles. The minister ordered the defense to be summoned and warned that failure to comply with precautionary measures could result in preventive detention, in accordance with article 312 of the Code of Criminal Procedure.
According to lawyers, Martins never had an active account on LinkedIn and did not make any type of public statement or communication through the platform. The defense maintains that, since February 8, 2024, when preventive detention was ordered, all access to the former advisor’s digital accounts has been under the exclusive control of the lawyers.
According to the petition, this control has strictly defensive purposes, such as preserving data, analyzing histories and identifying contacts relevant to the exercise of broad defense. The lawyers claim that there was no publication, interaction or sending of messages on behalf of the defendant.
“There was no violation of the precautionary measure, but technical and institutional action was compatible with judicial determinations”maintains the defense.
HOUSE ARREST
Moraes ordered Filipe Martins’ house arrest on December 27, 2025, after the attempted escape of Silvinei Vasques, former director of the PRF (Federal Highway Police). One of the measures imposed on the former advisor was the ban on the use of his own or third-party social networks.
In the decision, the minister cited the risk of evasion of those under investigation linked to the attempted coup d’état and mentioned the case of the former director of Abin (Brazilian Intelligence Agency) Alexandre Ramagem (PL-RJ), convicted by the STF and on the run abroad.
Martins is among 10 people under investigation subject to house arrest as ordered by the STF. Among them are former members of different groups of the coup attempt.
The president of Instituto Voto Legal, Carlos Rocha, was also the target of a warrant, but is considered a fugitive, after not being located in São Paulo.
PRECAUTIONARY MEASURES
Those investigated must comply, among other requirements:
- use of an electronic ankle bracelet;
- prohibition of using social networks, whether owned or belonging to third parties;
- restriction of contact with other people being investigated;
- delivery of passports and prevention of leaving the country;
- suspension of gun registrations;
- limitation of visits, except authorized lawyers.
