The Military Public Prosecutor’s Office should file this week, in the Superior Military Courta request for the expulsion of the former president Jair Bolsonaro of the Army, based on the rules of the Military Penal Code that deal with cases of “indignity for officialdom”.

In addition to Bolsonaro, the action also targets the former Navy commander Almir Garnier and the generals Augustus Helenus, Paulo Sérgio Nogueira e Walter Braga Netall convicted of Supremo Tribunal Federal in the process that uncovered the coup plot after the 2022 elections.
If the request is accepted by the STM, soldiers may lose posts and ranks, being excluded from the Armed Forces after a specific judgment on the conduct considered incompatible with officialdom. Data from the court itself indicate that 85% of cases due to indignity resulted in patent revocation, which reinforces the tendency towards punishment in this type of action.
The case now enters the sphere of Military Justice, which will analyze whether the convictions already imposed by the STF also constitute a violation of the duties and honor required of Armed Forces officers.
