The TJDFT (Court of Justice of the Federal District and Territories) approved extending the days of compensatory leave for magistrates to up to 18 days, a measure that ended up being blocked with the decision of the minister of the (Federal Supreme Court) of .
The change was approved by the full TJDFT during the 1st Virtual Ordinary Session, held from January 27 to February 4, 2026, and would come into force on the date of publication in the court’s Administrative Gazette, scheduled for Monday (9).
Compensatory leave is a type of benefit granted to compensate for work considered extraordinary, for example, on-call. It can be converted into time off or payment — which is a hassle.
The rule approved by the Federal District court amends one that establishes the granting of compensatory leave in the proportion of three days of work for one day of leave, with a limit of ten days per month.
With the change, the court added to the previous rule that magistrates could, in addition to the 10 days, have two days of leave per week worked, limiting themselves to eight days per month.
The resolution states that the payment of the penduricalho would be conditioned “on the existence of financial and budgetary availability”. The text is signed by the president of the court, judge Waldir Leôncio Júnior.
Wanted by Sheetthe TJDFT said, in a statement, that the resolution was taken before Dino’s decision “and that it was not implemented”.
“The Resolution published this Friday, 6/2, does not imply the immediate production of effects. Furthermore, article 2 mentions that the payment of expenses resulting from the change promoted by the Resolution is subject to the existence of financial and budgetary availability, a matter still under analysis by the technical units of the court and with no provision for deliberation by the president.”
UNDERSTAND DINO’S DECISION
In addition to suspending the restrictions in the Three Powers, the STF minister set this Thursday (5) a period of 60 days for all administration bodies to review funds paid and suspend those without a legal basis.
The decision will be submitted to the STF plenary. The president of the court, Luiz Edson Fachin, scheduled the analysis of the terms of the decision for a session on February 25th.
Among the funds considered trinkets by Dino are the so-called turkey aid and panettone aid, distributed to servers traditionally at the end of the year. According to him, even the nicknames given to payments violate the decorum of public functions.
The minister also mentions the payment of bonuses for the accumulation of processes, vacations and duties, travel allowance, fuel allowance and education allowance.
