The (National Council of Justice) received this Monday (9) a new complaint involving the minister of the (Superior Court of Justice) Marco Buzzi. A new disciplinary complaint was opened to investigate the facts.
According to the National Justice Inspectorate, a “hearing of a possible victim of facts similar to those subject to ongoing proceedings” was carried out. The investigation is being conducted in secrecy “to preserve the privacy and integrity of the people involved and for the proper conduct of the investigations.”
The lawyers claim that the minister “did not commit any improper act, as will be possible to demonstrate in due course within the scope of the procedures already initiated.” The note says that the leak of information seeks to “embarrass due legal process and unduly influence future judicial decisions.”
In addition to the disciplinary complaints at the CNJ, Buzzi is the target of a criminal investigation at the STF (Supreme Federal Court), which is being processed under the minister’s report, and an investigation within the scope of the STJ itself, led by ministers Raul Araújo, Francisco Falcão and Antônio Carlos Ferreira.
As shown by Sheetthe tendency is for the STJ to conclude that the minister will be removed after the investigation is concluded. Administrative processes result in compulsory retirement. A conviction in the Supreme Court for the crime of sexual harassment could lead to imprisonment and loss of retirement.
The first complaint points to an episode that occurred on January 9 in Balneário Camboriú (SC). The 18-year-old was staying with her parents at the minister’s beach house. According to the statement given to the São Paulo Civil Police, he tried to grab her in the sea. There are still no details about the second complaint.
Behind the scenes at the STJ, the situation is considered unfavorable for Buzzi and the case is classified as unprecedented in court. Ministers say they see no climate for impunity, a perception reinforced by the fact that the victim’s mother is a lawyer known and respected by the legal community.
