The São Paulo Court of Justice condemned an influencer for referring to (União Brasil-SP) as a neo-Nazi and calling it “human trash” and “katabosta” in social media posts.
With the second instance decision, Thiago dos Reis Pereira Santos will have to compensate Kim with R$20,000 for moral damages.
Santos appealed the decision, but the 4th Chamber of Private Law denied the request on Friday (6). The influencer argued his right to free expression of thought.
For judge Fatima Cristina Ruppert Mazzo, rapporteur of the action, the terms spoken against Kim are offensive, without any critical or humorous nature.
“The publications made by the defendant exceeded the constitutional limits of freedom of expression, having come up against the equally protected constitutional rights of the author: honor, dignity and image”, wrote Mazzo.
The Panel did not locate Santos.
