Judge backtracks and convicts man for raping 12-year-old girl

Case had been judged as ‘consensual emotional bond’

Judge Magid Nauef Láuar, of the 9th Criminal Chamber of the Court of Minas Gerais (TJMG), accepted the request of the Public Ministry and reformed its decision to acquit a 35-year-old man accused of raping a vulnerable of a 12 year old girl. The magistrate had acquitted the defendant, understanding that there was a “consensual emotional bond” between him and the victim.

O The judge also ordered the immediate issuance of arrest warrants against the man and the teenager’s motheralso investigated. With the first instance sentence upheld, he was sentenced to nine years and four months in prison. The judge also refused the defense’s appeals.

After the repercussion of the judge’s first decision, the filed a Request for Measures to investigate the actions of the TJMG and the judge.

The Public Prosecutor’s Office, which had denounced the suspectalso acted after the case was publicized and filed an appeal, accepted by the court this Wednesday. The conviction in the first instance had taken place in the District of Araguari.

The decision may be appealed.
