The federal government extended the start of the rule on work on commercial holidays for another 90 days. Ordinance 3,665/2023 determines that the operation of commerce on holidays depends on authorization provided for in a collective agreement between employers and workers, respecting municipal legislation. The decision of the Ministry of Labor will be made official in publication in the Official Gazette of the Union on Thursday the 26th.
“With the extension, the Government of Brazil extends the deadline for representatives of workers and employers to advance in negotiations on the regulation of the topic, reaffirming the commitment to social dialogue and the appreciation of collective bargaining”, says the Ministry of Labor in a note released this Wednesday, 25.
The Ministry also informed that a bipartite commission will be established, with 10 representatives from workers and 10 from employers. The entities will have five days to indicate to the ministry the names that will join the panel.
The objective of the commission, which will be advised by the Ministry of Labor, will be to debate the rules related to work on commercial holidays and seek consensus between the parties. “The measure reinforces the government’s directive to build negotiated solutions, with active participation of the sectors involved, ensuring balance in work relations and legal security for employees and employers.”
The measure corrects a rule introduced by the previous government, which issued Ordinance 671/2021 that unilaterally authorized work on holidays.
