The expert appointed to carry out the preliminary finding in the Fictor Group’s request for judicial recovery agreed on the inclusion of all the conglomerate’s companies in the process. Furthermore, it found the absence of activity in at least three subsidiaries. The report was filed in the records in the last few minutes of Wednesday night, the 25th.
At the beginning of the month, Fictor Invest and Fictor Holding filed a request for recovery with debts of around R$4 billion. The preliminary expertise, carried out by Laspro Consultores, says that both meet the requirements to enter into judicial recovery, in accordance with the legislation.
The document, to which the Broadcast (Grupo Estado’s real-time news system) had access, states that all business companies benefiting from fundraising through the form of Society in Participation Account (SCPs) must be led to restructuring, but asks the judge to determine a period of five days for Fictor to present the necessary documents so that the feasibility of inclusion can be analyzed.

Before the expert report, still this Wednesday, Fictor came forward and petitioned for other companies in the group to be included in the recovery.
Furthermore, without prejudice to the request for new documentation, the expert opinion already opines for the compulsory inclusion of other companies in the process, these are:
- Manufacturer of Alimentos Betim;
- Fictor Energy Marketer;
- Ficpass, Fictor Agro Holding;
- Maker of Agro Industry;
- Dynamis Clima SPE;
- Dynamis Beleza SPE;
- Dynamis Open Path SPE;
- Dynamis Mundo Melhor 2 SPE;
- Dynamis Novel SPE;
- Dynamis Parabens SPE;
- Dynamis Futuro 1 SPE;
- Dynamis Futuro 2 SPE.
The expert also considers the extension of protection against executions to the 28 subsidiaries and its extension for another 15 days.
At the beginning of the month, on February 3, judge Adler Batista Oliveira Nobre granted the so-called “stay period”, a 30-day protection from executions, charges and blocks against companies.
Inactive subsidiaries
In relation to the last report, which had found the lack of activity of several subsidiaries, the expert re-visited new addresses and went back in some cases.
