He Iustitia Europe party — who exercises the popular accusation in cases of great significance in Spain such as the Koldo, Begoña cases or the one that will put the brother of the President of the Government on the bench — has presented complaint before the International Criminal Court against the leaders of the US and Israel, Donald Trump and Benjamin Netanyahu, so that the Prosecutor’s Office of this body investigates possible war crimes and crimes against humanity in the conflict that began on February 28, 2026 against Iran.
This is the first complaint for these events before the international court based in The Hague, according to EL PERIÓDICO from the party. chaired by lawyer Luis María Pardo, and focuses on the attack on the Shajareh Tayyebeh girls’ school in Minab (Iran), where at least 165 minors died, and on the death of Maronite priest Pierre El-Rahi in Qlayaa (Lebanon) while helping civilians after a military attack.
Ask the Prosecutor’s Office to examine the possible individual criminal responsibility of the political and military leaders involved and to determine whether there are grounds to open a preliminary examination in accordance with the Rome Statute.

Death of 165 girls

According to the document presented, these events could constitute serious violations of International Humanitarian Lawincluding attacks against the civilian population, attacks against civilian objects—such as educational facilities—and homicides of protected persons.
The communication also requests the Prosecutor’s Office to examine whether the military campaign that began on February 28, 2026 against Iranian territory could constitute a act of aggression contrary to the Charter of the United Nations, having allegedly occurred without authorization from the Security Council.
Iustitia Europa recalls that the International Criminal Court has jurisdiction to examine communications submitted by any person or organization under Article 15 of the Rome Statute, with the Prosecutor’s Office being the only competent authority to determine whether there is a reasonable basis to open a preliminary examination.
Jurisdiction analysis
Likewise, the organization notes that the question of the Court’s jurisdiction—including the analysis relating to States that are not parties to the Rome Statute—is part of the legal examination that corresponds to be carried out exclusively by the Prosecutor’s Office and, where appropriate, to the Chambers of the Court, in accordance with the Statute itself.
The president of Iustitia Europa and lawyer Luis María Pardo points out, for his part, that the reason for this complaint is for the Prosecutor’s Office to independently analyze the reported facts. “The International Criminal Court was created precisely to examine the most serious crimes that affect the international community. When there are indications of attacks against civilians, against children or against humanitarian personnel, it is up to international institutions to analyze the facts with independence and rigor.”
